Terms of Service

1. About MyOgaTutor

MyOgaTutor ("we", "us", "our") is an educational technology platform operated by Nesta Connect Limited and available at www.myogatutor.com. The platform includes AI tutoring, exam-practice tools, Virtual Science Lab experiences, teacher tools, and school-account features.

By creating an account, purchasing a plan, joining a school account, or otherwise using MyOgaTutor, you agree to these Terms of Service and any policies incorporated by reference, including our Privacy Policy and Refund Policy.

2. Nature of the Service

• MyOgaTutor provides educational support and learning tools. It does not replace qualified teachers, schools, examination bodies, or professional academic advice.
• AI-generated content may occasionally contain errors, omissions, or unsuitable explanations. Important information should be checked against trusted teaching materials, official syllabi, or a qualified educator.
• Virtual Lab activities are training and practice experiences. They do not replace every requirement of a supervised physical laboratory where one is required by a school, examination body, or regulator.
• MyOgaTutor does not guarantee any specific examination result, grade, admission, academic outcome, or professional recognition.
• MyOgaTutor certificates confirm completion of specified MyOgaTutor training activities. They are not issued by WAEC, NECO, JAMB, or another examination body.

3. Eligibility and Accounts

To use MyOgaTutor you must:

• Be at least 13 years old.
• If you are under 18, use the service with appropriate parent, guardian, or school awareness where required.
• Provide accurate information when creating or managing an account.
• Use a valid email address and complete any required account verification.
• Keep your login credentials secure and not allow unauthorised use of your account.

School administrators are responsible for ensuring that people they invite or enrol are authorised to use the relevant school account.

4. Acceptable Use

You must not use MyOgaTutor to:

• Submit unlawful, abusive, harmful, or deliberately disruptive content.
• Attempt to bypass plan limits, payment controls, authentication, or security measures.
• Create or coordinate accounts for the purpose of abusing free or paid entitlements.
• Share account credentials in a way that gives unauthorised people access to paid features.
• Interfere with the operation, availability, or security of the service.
• Reverse engineer, scrape, copy, or reproduce protected parts of the platform except where permitted by law.
• Use generated content in a way that infringes another person's rights or violates applicable law.

We may restrict, suspend, or terminate access where reasonably necessary to protect users, the platform, payment systems, or other customers, or where these Terms are materially breached.

5. Student Plans and Virtual Lab Access

Current student access includes a Free level and the paid Student Plan.

• Free: 10 AI questions per day, together with available free learning features.
• Student Plan: ₦1,000 per month, with up to 250 AI questions per day and full Virtual Science Lab access while the subscription is active.

Full Virtual Lab access includes Guided and Exam modes for supported Chemistry, Physics, and Biology practicals. Eligible completed sessions may provide downloadable laboratory reports and MyOgaTutor Practical Skills Certificates subject to the applicable completion requirements.

Legacy internal plan identifiers may continue to appear in account or payment records for backwards compatibility. They do not change the customer-facing Student Plan entitlement.

6. Teacher and School Plans

The paid Teacher Plan is ₦1,500 per month and includes eligible teaching and authoring tools, supported curriculum features, and full Virtual Science Lab access.

School plans provide organisation-level access, membership management, authorised learning analytics, and Virtual Lab access according to the purchased tier and seat limits:

• Starter: ₦40,000 per term or ₦100,000 per full academic session, including Guided Virtual Lab access.
• Growth: ₦65,000 per term or ₦160,000 per full academic session, including Full Virtual Lab access.
• Institution: ₦100,000 per term or ₦250,000 per full academic session, including Full Virtual Lab access and higher capacity.
• Virtual Lab Only: ₦30,000 per term or ₦75,000 per full academic session, initially covering up to 100 students and providing Full Lab access without the wider paid school-platform entitlement.

For school plans, Guided Lab does not include Exam mode. Full Labincludes Guided and Exam modes. An active paid personal Student or Teacher subscription may provide Full Lab access independently of a user's school tier.

6A. Adaptive Virtual Lab Premium

Adaptive Virtual Lab Premium is an optional premium add-on to an active Full Virtual Lab entitlement. It does not replace the validated Standard Lab scenario bank.

• Individual add-on: ₦3,000 per month in addition to an eligible active personal Student or Teacher Full Lab plan.
• School add-on: ₦60,000 per term or ₦150,000 per full academic session on eligible Growth, Institution, or Virtual Lab Only plans.
• Starter schools: not eligible for Adaptive Lab Premium because Starter provides Guided Lab rather than Full Lab.

Adaptive scenarios are generated within controlled scientific and curriculum rules and may vary concentrations, unknown samples, apparatus parameters, measurements, materials, specimens, and environmental conditions. They are training simulations and do not claim to represent every conceivable real-world laboratory condition.

Canonical scenario data, marking decisions, pass/fail outcomes, and entitlement checks remain server-authoritative. Prices and the total amount payable are shown before checkout.

7. School Membership and Privacy

A student's verified school membership is separate from any personal subscription the student may hold.

Authorised school staff may view membership information and privacy-safe learning analytics made available through school features. Private AI conversation content is not made available to school staff through the school dashboard.

School access may expire, be suspended, or be removed independently of a user's personal plan, and a personal plan may remain active independently of school membership.

8. Payments, Billing and Cancellation

• Prices, billing periods, included features, and any promotional offers are shown on the relevant purchase page before payment.
• Individual Student and Teacher subscriptions are currently billed monthly. School licences may be purchased per term or for a full academic session as shown on the relevant purchase page.
• Payments are processed through Paystack. We do not store full payment-card details.
• A payment must be successfully verified before a paid entitlement is activated.
• Where cancellation is available, cancelling stops future renewal but does not normally end already-paid access before the applicable expiry date.
• Refund eligibility is governed by our Refund Policy and applicable law. Nothing in these Terms removes rights that cannot legally be excluded.
• We may change prices or plan features from time to time. Where required, affected users will be notified before a change applies to a future billing period.

9. Usage Limits and Service Availability

Some plans include daily or other usage limits. Limits are part of the plan entitlement and may be enforced automatically by the platform.

We aim to keep MyOgaTutor available and reliable, but we do not guarantee uninterrupted availability. Maintenance, third-party outages, security events, or technical problems may temporarily affect access.

10. Intellectual Property

MyOgaTutor's branding, software, design, original platform content, and underlying technology are owned by or licensed to Nesta Connect Limited and are protected by applicable intellectual-property laws.

Content that you submit remains yours to the extent you own it. You give us the permissions reasonably necessary to process that content to provide, secure, and operate the service, in accordance with our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nesta Connect Limited is not responsible for losses arising solely from:

• Reliance on inaccurate or incomplete AI-generated educational content
• Examination, admission, or academic outcomes
• Temporary interruption or unavailability of the service
• Unauthorised use caused by a user's failure to protect account credentials

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

12. Changes to These Terms

We may update these Terms as MyOgaTutor evolves. We will update the "Last updated" date and may provide additional notice for material changes where appropriate. Continued use after an updated version takes effect constitutes acceptance of the updated Terms, subject to rights available under applicable law.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be handled by courts or other competent dispute-resolution bodies with jurisdiction under applicable law.
